Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules for using the Lupa buyer app, the Seller Hub, and the TrackIt Pro rider app (the "Services"). It applies to all users and forms part of our Terms of Service. Using the Services means you agree to this AUP.

1. General Conduct

You agree to use the Services lawfully, honestly, and respectfully, and in compliance with all applicable Zambian law, including the Electronic Communications and Transactions Act No. 4 of 2021 and the Data Protection Act No. 3 of 2021.

2. Prohibited Activities

You must not:

  • Break the law — use the Services for any unlawful purpose or to facilitate a crime.
  • Defraud others — engage in scams, chargeback fraud, fake orders, or deceptive practices.
  • List prohibited items — see our Prohibited & Restricted Items Policy.
  • Circumvent the platform — arrange off-platform payments to avoid escrow, fees, or buyer protection.
  • Manipulate ratings — post fake reviews, inflate ratings, or coerce feedback.
  • Misrepresent identity — use false names, impersonate others, or provide forged KYC documents.
  • Abuse other users — harass, threaten, discriminate against, or use hate speech toward any buyer, seller, rider, or staff member.
  • Compromise security — attempt to hack, scrape, reverse-engineer, overload, or introduce malware into the Services.
  • Misuse data — collect or use other users' personal data for any purpose other than completing a transaction.
  • Spam — send unsolicited bulk or commercial messages through the in-app chat.
  • Launder funds — use the platform to launder money or finance illegal activity (see our AML/CTF Policy).

3. Seller-Specific Rules

Sellers must additionally:

  • describe goods accurately and honour listed prices and stock;
  • ship the correct goods promptly and prepare orders for collection on time;
  • not list counterfeit, restricted (without authorisation), or prohibited items; and
  • honour valid refund and return decisions.

4. Rider-Specific Rules

Riders must additionally:

  • verify the delivery PIN before completing handover;
  • handle goods and customer data responsibly and confidentially;
  • not tamper with, open, or misappropriate order contents; and
  • comply with road traffic law and act safely and professionally.

5. Content You Submit

You are responsible for content you post (listings, photos, reviews, messages). You must own or have the right to use it, and it must not be unlawful, misleading, infringing, or offensive. We may remove content that breaches this AUP.

6. Monitoring & Enforcement

We may monitor activity to enforce this AUP. Where it is breached, we may, without prior notice and at our discretion, issue a warning; remove content or listings; restrict features, hold payouts, or freeze funds; suspend or permanently terminate the account; and report the matter to the relevant authorities. The severity of action reflects the severity and frequency of the breach.

7. Reporting Abuse

Report suspected violations in-app or to support@lupasphere.com.

8. Changes

We may update this AUP from time to time. Continued use of the Services after changes constitutes acceptance. Significant changes will be communicated via in-app notification.
