Lupa Delivery Rider Terms of Service

By accessing or using the TrackIt Pro mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Acceptance of Terms

By logging in or using TrackIt Pro, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Rider Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current information. Lupa reserves the right to suspend or terminate accounts that violate these Terms.

3. Delivery Services

As a rider, you accept and fulfil delivery assignments. You agree to handle packages with care, deliver promptly, update status accurately, and comply with Zambian traffic and safety laws.

3a. Collection PIN Verification

Each order you accept is assigned a unique 6-digit Collection PIN, visible on your job card in the App. On arrival at a seller's premises, you must present this PIN to the seller before any items are handed over. The seller will enter the PIN in their app to create a verified handoff record. You may not mark an order as "Picked Up" until the PIN has been verified. For multistore orders (multiple pickup stops), every seller stop must independently verify the PIN before you can proceed to the delivery phase; partial verification is not sufficient. You must not attempt to collect packages from any seller who has not completed PIN verification, and you must not solicit or pressure sellers to skip verification.

3b. Multistore Orders

Multistore orders require you to visit each listed seller stop in sequence. Each stop has its own PIN verification requirement as described in Section 3a. All stops must be verified before the order status can advance to "Picked Up." Delivery to the buyer proceeds only after all pickups and PIN verifications are complete.

3c. Delivery PIN Verification

At the point of delivery, the buyer will provide a 6-digit Delivery PIN. You must enter this PIN in the App to confirm the handoff to the correct recipient. Do not leave packages without obtaining Delivery PIN confirmation unless an alternative procedure is explicitly approved by Lupa for a specific order.

4. Independent Contractor Status

You operate as an independent contractor, not an employee. You are responsible for your own equipment, vehicle, insurance, and tax obligations.

5. Compensation & Commission

Delivery fees are displayed before acceptance. Lupa charges a platform commission of 15% of each delivery fee, deducted from your float balance at the point of job acceptance. Payouts for net earnings are processed weekly to your Mobile Money account. You must maintain a sufficient float balance to accept jobs; the required float amount is shown before each acceptance. Fee schedules may change with 14 days notice.

6. Privacy

Location data is collected during active deliveries only. Identity documents are stored securely for verification and dispute resolution. Data is handled per the Data Protection Act No. 3 of 2021 of Zambia.

7. Prohibited Conduct

Do not misrepresent delivery status, tamper with packages, share customer info, or use the App unlawfully.

8. Limitation of Liability

The App is provided "as is." Lupasphere Integrated Platforms Limited's liability is limited to delivery fees earned in the preceding 90 days.

9. Governing Law

These Terms are governed by the Laws of the Republic of Zambia.
