Prohibited & Restricted Items Policy

To keep the Lupa marketplace safe and lawful, this Policy lists items that may never be listed or sold ("Prohibited Items") and items that may only be listed under specific conditions ("Restricted Items"). It applies to all sellers and forms part of the Seller Agreement and Acceptable Use Policy.

1. Prohibited Items (Never Allowed)

Sellers must not list, sell, or facilitate the sale of:

  • illegal drugs and narcotics, controlled substances, and related paraphernalia;
  • weapons and explosives — firearms, ammunition, explosives, and parts thereof;
  • counterfeit and replica goods, and unauthorised reproductions;
  • stolen goods or items obtained unlawfully;
  • endangered species and wildlife products (e.g. ivory, pangolin scales) protected under Zambian wildlife law and CITES;
  • human remains, organs, or bodily fluids;
  • hazardous materials — toxic, radioactive, or otherwise dangerous substances;
  • child sexual abuse material and any content that exploits or endangers minors;
  • items promoting hate, terrorism, or violence;
  • government-issued documents and credentials — IDs, passports, certificates, or licences (genuine or fake); and
  • counterfeit currency or financial instruments.

2. Restricted Items (Allowed Only Under Conditions)

The following may only be listed where the seller holds all required licences/permits and complies with applicable Zambian law. Lupasphere may require proof before approving listings:

  • Alcohol and tobacco — only by licensed sellers, and only to buyers aged 18+ with age verification at delivery.
  • Pharmaceuticals and medical devices — only by entities authorised by the Zambia Medicines Regulatory Authority (ZAMRA); no prescription-only medicines without lawful authorisation.
  • Health supplements and cosmetics — must comply with applicable safety and labelling rules.
  • Telecommunications and electronic equipment — must comply with ZICTA type-approval where applicable.
  • Agricultural inputs — pesticides, fertilisers, and chemicals subject to permit requirements.
  • Live animals and plants — subject to animal welfare, health, and permit requirements.
  • Second-hand goods — must be lawfully owned, accurately described, and not subject to recall.
  • Adult products (18+) — only where lawful, age-gated, and not explicit material prohibited by law.

3. Accurate Listings

All items must be described truthfully, with accurate photos, condition, and pricing. Misleading listings are prohibited under our Acceptable Use Policy and Zambian consumer law.

4. Enforcement

Where this Policy is breached, Lupasphere may, without prior notice, remove the listing; hold or reverse related payments; suspend or terminate the seller's account; withhold payouts; and report the matter to the relevant authorities (e.g. Drug Enforcement Commission, Zambia Police, ZAMRA, ZICTA, or CCPC).

5. Reporting Violations

If you see a listing that breaches this Policy, report it in-app or email support@lupasphere.com.
